1. WHO WE ARE

This policy explains how byMATTER collects, uses and protects personal information when you visit bymatter.com, buy from us, or contact us.

bymatter.com is operated by BYMATTER LTD, a company registered in England and Wales under company number 12855001, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. VAT number GB371281113. We are the data controller for the information described in this policy.

This policy covers bymatter.com only. Orders placed through marketplaces or partner sites, including Amazon and any promotional microsite operated on our behalf, are covered by the privacy policy published on those sites.

2. INFORMATION WE COLLECT

Information you give us

  • Name, email address, delivery and billing address, phone number
  • Order details and payment information. Card payments are handled by our payment provider. We do not store full card numbers
  • Account details, including your password in encrypted form
  • Marketing preferences
  • Reviews, survey responses and competition entries
  • The content of messages you send us, including any attachments

Information collected automatically

  • IP address, browser type and version, device type and operating system
  • Pages viewed, time on site, clicks, referring and exit pages
  • Approximate location derived from your IP address
  • Cookies and similar identifiers, described in section 6

3. HOW WE USE YOUR INFORMATION

You can withdraw consent or opt out of marketing at any time, using the unsubscribe link in any email or by emailing hello@bymatter.com. Opting out of marketing does not stop messages about orders you have placed.

4. WHO WE SHARE IT WITH

We do not sell your personal information.

We share it with providers who process it on our behalf, under contract and only on our instructions:

  • Shopify, which hosts our store and processes payments
  • Klaviyo, which sends our email marketing
  • Our fulfilment and delivery partners in the United Kingdom and the United States, who need your name and address to ship your order
  • Google Analytics
  • Professional advisers, including our accountants

We may also disclose information where the law requires it, or in connection with a sale or restructuring of the business.

5. INTERNATIONAL TRANSFERS

We are based in the United Kingdom. Some of our providers and our United States fulfilment operations are based outside the UK. Where personal information is transferred outside the UK or the European Economic Area, we rely on an adequacy decision, the UK International Data Transfer Addendum, or the European Commission's standard contractual clauses, so that your information remains protected.

6. COOKIES

Cookies are small files stored on your device when you visit a website. We use three kinds:

  • Essential cookies, which make the site work. These include keeping items in your basket and processing checkout. The site cannot function without them
  • Analytics cookies, which show us how the site is used so we can improve it
  • Marketing cookies, which are used to show you relevant advertising

Analytics and marketing cookies are only set where you have agreed to them. You can change your choices at any time through your browser settings. Blocking essential cookies will stop parts of the site working.

7. HOW LONG WE KEEP IT

  • Order and transaction records: seven years, to meet tax and accounting requirements
  • Account information: for as long as your account is open, and for 12 Months afterwards
  • Marketing contacts: until you unsubscribe. We then keep a minimal record so that we do not contact you again
  • Enquiries and customer service messages: 12 Months
  • Website analytics: 12 Months

8. YOUR RIGHTS

If you are in the United Kingdom or the European Economic Area

You have the right to:

  • Ask for a copy of the personal information we hold about you
  • Ask us to correct information that is inaccurate or incomplete
  • Ask us to delete your information, in certain circumstances
  • Ask us to restrict how we use your information, in certain circumstances
  • Object to how we use your information. Where you object to direct marketing, we will always stop
  • Ask us to transfer your information to another organisation, in certain circumstances
  • Withdraw your consent at any time, where we rely on consent

There is no charge for making a request. We will respond within one month. If a request is complex we may take up to two further months, and we will tell you if that happens.

If you are unhappy with how we have handled your information you can complain to the Information Commissioner's Office at ico.org.uk, or to the supervisory authority in your country.

If you are in the United States

Depending on where you live, you may have the right to know what personal information we hold, to have it deleted or corrected, to opt out of the sale or sharing of your information and of targeted advertising, and not to be treated differently for exercising these rights. We do not sell personal information. To make a request, email hello@bymatter.com.

9. SECURITY

We use appropriate technical and organisational measures to protect your information, and we require our providers to do the same. No transmission over the internet can be guaranteed completely secure, so we cannot promise absolute security, but we take the protection of your information seriously and review our arrangements regularly.

10. CHILDREN

Our site is not directed at children and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us their information, contact us and we will delete it.

11. CHANGES TO THIS POLICY

We may update this policy from time to time. The date at the top shows when it was last changed. Where changes are significant we will tell you by email or through a notice on the site.
